1. Acceptance of these Terms
By creating an account, selecting an acceptance checkbox, accessing a restricted feature, uploading or entering data, or otherwise using AnalysisSwim, you agree to these Terms of Use and the documents expressly incorporated into them.
If you do not agree, do not create an account and do not use the platform's interactive, analysis, communication or training features. Certain public pages may remain available for general information.
If you use AnalysisSwim on behalf of a club, team, organisation or another person, you confirm that you are authorised to accept these Terms for them.
2. Platform operator
AnalysisSwim and analysisswim.com are operated from Singapore by Ivashyn Siarhei (the “Operator”, “AnalysisSwim”, “we”, “us” or “our”).
3. Eligibility, age and minors
- Users aged 18 or older may accept these Terms for themselves.
- Users aged 13 to 17 may use AnalysisSwim only with permission from a parent or legal guardian and with appropriate responsible-adult supervision.
- A person under 13 must not create or control an independent account. Any permitted use relating to a child under 13 must be managed by a parent or legal guardian through an adult account and only where the platform provides an appropriate parent-managed feature.
A parent or legal guardian who permits a minor to use AnalysisSwim accepts these Terms for the minor, is responsible for the minor's activity and must ensure appropriate supervision, safeguarding and lawful handling of the minor's data.
Coaches, clubs and other users must not invite, collect data about or communicate with a minor unless they have all permissions and safeguarding arrangements required by applicable law and their organisation.
4. Accounts and account security
You must provide accurate, current information and keep it updated. You are responsible for protecting your password, recovery email and authenticated sessions, and for activity performed through your account unless applicable law provides otherwise.
Do not share credentials or allow another person to impersonate you. Notify us promptly at info@analysisswim.com if you believe your account has been accessed without permission.
Roles such as Athlete, Coach, Parent or Club Manager describe platform access and do not constitute professional certification, identity verification, employment, agency or endorsement by AnalysisSwim.
5. Purpose and scope of the Service
AnalysisSwim provides tools and content for swimming education, planning, communication, record keeping and performance review. Features may include Race Analysis, Swim or Video Analysis, Pace Clock, workout and training tools, personal-best tracking, comparisons, reports, statistics, reference data, messages, notifications and team-management functions.
Features may be experimental, calculated, manually entered, automated or based on third-party or user-supplied information. Availability and behaviour may vary by account role, subscription, device, browser, location and service version.
6. Analysis results and accuracy limitations
Times, splits, distances, velocities, stroke rate, stroke count, distance per stroke, stroke index, pacing, start and turn measurements, comparisons, predictions, rankings, recommendations and other outputs may be affected by:
- video angle, frame rate, resolution, compression, lighting and visibility;
- manual marker placement, reaction time and interpretation;
- incorrect pool, course, distance, stroke, event or athlete settings;
- incomplete, inaccurate or outdated user or reference data;
- rounding, browser timing, device performance and software limitations;
- changes in rules, measurement methods or underlying calculations.
AnalysisSwim output is not an official race result, certified timing system, governing-body decision, guaranteed prediction or promise of performance. Official results and applicable competition rules always take priority.

7. Health, water safety and assumption of risk
Swimming, breath control, diving, starts, turns, underwater activity, strength work and physical training involve inherent risks, including overexertion, collision, illness, injury, drowning and death. You voluntarily assume the risks connected with activities you choose to perform, subject to rights and liabilities that cannot lawfully be excluded.
Obtain appropriate medical advice where necessary, follow the instructions of qualified professionals, use suitable facilities and equipment, and ensure appropriate lifeguard, coach, parent or responsible-adult supervision. Stop an activity and seek professional or emergency help if there is pain, distress, illness, unsafe conditions or uncertainty.
8. Coach, athlete, parent and club connections
Platform connections are voluntary digital permissions. AnalysisSwim does not guarantee a user's identity, qualifications, background, authority, conduct or suitability. Users and organisations are responsible for their own verification, safeguarding checks, supervision, agreements and compliance obligations.
Access permissions may allow a confirmed connection to view or manage certain sports data. Passwords, payments and private account-security settings are not intentionally shared through sports connections. Review permissions before accepting a connection and remove, pause or block access when appropriate.
Messaging is available only where the platform permits it. Messages may be filtered, blocked, reported or reviewed in limited context for safety and moderation. Automated moderation may make mistakes and is not a substitute for responsible adult supervision or reporting urgent danger to local authorities.
9. User content, videos and personal data
You retain any rights you lawfully hold in content you submit. You grant AnalysisSwim a non-exclusive, worldwide, royalty-free licence to host, process, reproduce and display that content only as reasonably necessary to operate, secure, support and improve the features you request, subject to the applicable privacy notice and account settings.
You confirm that you have a lawful basis, permission and all necessary consents to upload, analyse, store or share videos, names, results and other information, particularly information concerning minors or another athlete. Do not upload private, copyrighted or personal material that you are not authorised to use.
You are responsible for keeping your own copies of important videos, analyses, reports and records. AnalysisSwim is not a permanent archival or backup service unless a feature expressly says otherwise.
10. Acceptable use and platform safety
You must not use AnalysisSwim to:
- break any law, regulation, competition rule or third-party right;
- harass, threaten, exploit, groom, sexualise or endanger any person;
- share pornography, sexual content involving minors or abusive material;
- impersonate another person or misrepresent qualifications or authority;
- publish private contact details or sensitive information without authority;
- submit knowingly false reports, evidence, results or safety complaints;
- circumvent access, moderation, quotas, payment or security controls;
- introduce malware, scrape protected data or disrupt the Service;
- use outputs to make deceptive claims about performance or certification.
We may remove content, preserve evidence, limit features, warn users, restrict messaging, suspend accounts or cooperate with lawful authorities where reasonably necessary for safety, security, compliance or enforcement.
11. Reference races and third-party information
Reference analyses, athlete names, competition details, links and performance information may be compiled from original AnalysisSwim work, public records, authorised submissions or third-party sources. A source or verification link does not mean that the source endorses AnalysisSwim.
Public and historical information may contain errors, naming differences, corrections or later changes. Verify material information with the relevant athlete, organiser or governing body before relying on it.
12. AnalysisSwim intellectual property
The platform software, interface, branding, original text, designs, calculation structures, original analysis work and compiled materials are owned by or licensed to AnalysisSwim and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.
You may use platform output for your own lawful personal, coaching, athlete or internal club purposes. You must not resell, clone, systematically extract, republish or create a competing database from protected platform materials without prior written permission, except where applicable law permits it.
13. Subscriptions, paid services and credits
Where paid features, subscriptions or platform credits are offered, the price, currency, included service, renewal terms and any additional conditions will be displayed before purchase. You authorise the stated charge when you confirm a purchase.
Platform credits, coins or similar units have no cash value, are not bank money or cryptocurrency, and are not transferable or redeemable for cash unless the purchase terms expressly state otherwise. Mandatory refund and consumer rights remain unaffected.
Paid functionality is not active merely because it is described in these Terms. Additional payment terms may be introduced before monetised features launch.
14. Availability, changes and data preservation
We may maintain, update, replace, limit or discontinue a feature. We do not guarantee uninterrupted availability, compatibility with every device, permanent storage or error-free operation. Maintenance, hosting failure, browser changes, network conditions, security events or circumstances outside our reasonable control may interrupt access.
Where reasonably practicable, we will provide notice of material changes that significantly affect paid services or stored user data.
15. Disclaimers of warranties
To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available”. AnalysisSwim does not make warranties that the Service will be uninterrupted, secure, error-free, suitable for a particular training decision, or that any result, prediction, recommendation, reference record or user-provided statement will be accurate or complete.
Nothing in these Terms excludes an express commitment made in a specific paid service description or any guarantee, condition or right that applicable law does not permit us to exclude.
16. Limitation of liability
To the fullest extent permitted by applicable law, AnalysisSwim and the Operator will not be liable for indirect, incidental, special, exemplary or consequential loss, lost profits, lost opportunity, loss of reputation, loss of expected performance, or loss or corruption of data arising from or connected with use of or inability to use the Service.
To the fullest extent permitted by applicable law, AnalysisSwim is not liable for injury, loss or damage caused by reliance on estimated analysis, user-supplied or third-party data, unsafe activity, lack of supervision, another user's conduct, or a decision taken by a user, coach, parent, club or organisation.
Where liability cannot be excluded but may be limited, the total aggregate liability of AnalysisSwim arising from the Service will not exceed the greater of (a) the amount you paid directly to AnalysisSwim for the affected Service in the 12 months before the event giving rise to the claim, or (b) SGD 100.
Nothing in these Terms excludes or limits liability for fraud or fraudulent misrepresentation, wilful misconduct, death or personal injury to the extent caused by negligence where exclusion is prohibited, obligations under applicable data-protection law, or any other liability or consumer right that cannot lawfully be excluded or limited.
17. Responsibility for claims caused by your conduct
To the extent permitted by applicable law, you will be responsible for reasonable losses, liabilities and costs incurred by AnalysisSwim because of your unlawful content, breach of these Terms, infringement of another person's rights, lack of authority to submit personal data, or deliberate misuse of the Service. This clause does not require a consumer to indemnify AnalysisSwim for AnalysisSwim's own unlawful conduct or responsibility.
18. Suspension and termination
You may stop using the Service at any time and may request account closure through the available account process or by contacting us. Some records may be retained where reasonably necessary for security, dispute resolution, legal compliance or the rights of other users, subject to applicable data-protection law.
We may restrict, suspend or terminate access where reasonably necessary because of a serious or repeated breach, safety risk, unlawful use, fraud, non-payment, attack on the Service or legal requirement. Where appropriate and lawful, we will provide notice or an opportunity to correct the issue.
19. Governing law and disputes
These Terms are governed by the laws of Singapore, without regard to conflict-of- law principles. Subject to any mandatory rights you have under the law of your country of residence, disputes may be brought before the courts of Singapore.
Before starting formal proceedings, please contact info@analysisswim.com with a clear description of the issue so the parties can attempt to resolve it in good faith. This does not prevent either party from seeking urgent relief or using a mandatory consumer or regulatory procedure.
20. Changes, severability and language
We may update these Terms to reflect service, safety, legal or operational changes. The version and effective date will be displayed. Material changes may require a new affirmative acceptance before continued use of affected features.
If a provision is found invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue to apply. Failure to enforce a provision immediately is not a waiver.
The English version is the controlling version to the extent permitted by law. Translations may be provided for convenience and must not reduce mandatory rights.
